Political Asylum

  1. Things to Consider

    • Political asylum is a form of immigration relief for individuals who fear returning to their country of origin.
    • Individuals who meet the following requirements, may be eligible for asylum:
      • Currently present in the United States;
      • Seek asylum in the United States within one year of entry;
      • Unable to return to their own country due to being persecuted in the past or fear of future persecution; and
      • Have been or will be targeted for persecution in country of origin because of race, religion, nationality, membership in a particular social group, or political opinion.
    • You may not qualify for political asylum if:
      • You have participated in persecution of others or
      • You have been firmly resettled (i.e. received permanent residency) in a country other than your home country or the United States.
    • If you are granted asylum, you will be allowed to live and work in the United States. You will also be able to apply for permanent resident status one year after you are granted asylum.
    • You may include your spouse and unmarried child under 21 years in your own asylum application if your spouse and children are in the United States.

Asylum Nunc Pro Tunc

  1. Things to Consider

    • The Nunc Pro Tunc Asylum filing procedure is designed for derivative asylees (not derivative refugees) who have lost their status and their right to adjust inadvertently or through no fault of their own.
    • By filing an Asylum Nunc Pro Tunc application, the derivative asylee obtains a grant of asylum in their own right, and can then file for an adjustment of status and obtain permanent residency.
    • A derivative asylee may need to file a Nunc Pro Tunc application where:
      • The principal asylee applicant dies;
      • The derivative asylee child marries;
      • The derivative asylee spouse divorces the principal asylee applicant;
      • The derivative asylee step-child’s parent divorces the principal asylee applicant;
      • The derivative asylee withdraws his or her asylum claim;
      • The derivative asylee child turns 21 and is not protected by the Child Status Protection Act; or
      • The principal asylee spouse or parent becomes a US Citizen.
